General Provisions
This regulation, hereinafter referred to as the Regulation, defines the rules for providing services on the website rollfusion.pl, the rules for using the services, and the rules for protecting the personal data of Users.
The website is provided by Roll Fusion sp. z o.o., located in Warsaw (00-773), 41/2 Dolna Street, registered in the Register of Entrepreneurs of the National Court Register under the number KRS: 0001107986, NIP: 5214071661, REGON number: 528747233, e-mail: rollfusion2024@gmail.com
The provision of access to the Website is a service provided electronically by the Service Provider to the Users, in accordance with the Act of 18 July 2002 on the provision of electronic services (Dz.U. z 2002 r., Nr 144, poz. 1204, with amendments), and is carried out on the basis of an agreement concluded between the User and the Service Provider and based on the Regulation.
The Regulation applies to all services provided on the Website, excluding services governed by separate regulations. The Service Provider specifies on the Website which types of services are provided based on separate regulations.
Before using the Website, Purchasers are obliged to read the Regulation. Starting to use the Services implies full acceptance of the terms of the Regulation.
The Service Provider provides the Regulation free of charge through the website rollfusion.pl to Users before concluding the Agreement in the information system, as well as in a format that allows it to be downloaded, saved, and printed.
From the moment of starting to use the services, everyone is obliged to comply with the Regulation.
Definitions
Service Provider – Roll Fusion sp. z o.o., located in Warsaw (00-773), 41/2 Dolna Street, registered in the Register of Entrepreneurs of the National Court Register under the number KRS: 0001107986, NIP: 5214071661, REGON number: 528747233, e-mail: rollfusion2024@gmail.com
User – a natural person with at least limited legal capacity, a legal entity, an organizational unit without legal personality, who uses the services provided by the Service Provider based on the Regulation.
Restaurant – Roll Fusion restaurant offering its products on the website www.rollfusion.pl
Services – services provided electronically by the Restaurant to the Users based on the Regulation.
Agreement – an agreement concluded between the User and the Service Provider, authorizing the User to use the online marketplace and the products and services provided by the Service Provider on it, in accordance with the terms set out in this Regulation.
Terms of service provision by the service provider
The Service Provider makes every effort to ensure that the information presented on the Website, concerning individual offers and the geographical areas in which the Services are provided, is as up-to-date as possible, but there may be situations where a given product is temporarily unavailable. The Service Provider undertakes to inform the User about this as soon as possible, no later than 60 minutes after placing the order.
If the electronic payment option is selected, the order is considered successfully placed when the Service Provider receives a positive authorization response from the Payment System, which the Service Provider informs the User about by displaying an appropriate message on the screen. In the case of receiving a negative authorization response, the order cannot be fulfilled, and the User is immediately informed via a message displayed on the screen. In the event of receiving a positive authorization response and the order not being fulfilled by the Service Provider, the User is obliged to immediately inform the Service Provider by e-mail at rollusion2024@gmail.com or by phone at +48721769083.
Payments
The User may pay in cash or by card upon delivery made by the Service Provider, or through online payments. Credit card and e-transfer transactions are processed through stripe.com.
All prices listed on the website include VAT (value-added tax).
All electronic payments are made in accordance with the applicable regulations of the Payment System Operator or the Payment System partner, and the Service Provider is not responsible for their correctness.
Cash payments are made to the courier delivering the ordered products with a receipt. In the event of the inability to successfully deliver the order to the Restaurant, the User will receive a full refund of the payment made through the Payment System from the Service Provider. The refund request by the Service Provider will be processed no later than 72 business hours from the receipt of the information by the Service Provider about the non-fulfillment of the order for the reasons mentioned in this point (in the case of payment by bank transfer) and up to 14 business days in the case of payment by credit card. The date of the refund is considered the date on which the Service Provider submits the refund request to the Payment Operator.
The Payment System partners and the Payment System Operator reserve the right to refuse to process payments made by the User, especially in the event of doubts about the legality of the transaction for which the payment is made or the legality of the payment itself. For these reasons, the Service Provider may also refuse to accept the payment.
The Payment System Operator is not responsible for delays in processing payments or authorization responses caused by reasons arising after the User submits the payment instruction, as well as for the non-fulfillment or delay in transferring the due funds or verifying the data, especially caused by the provision of incorrect or incomplete data by the User, which makes it impossible to complete the payment transaction, as well as for delays resulting from other events beyond the control of the Service Provider or the Payment System Operator.
Return and order cancellation policy
Cancellation or modification of a placed order is possible only by phone to the restaurant number +48721769083, also available at: www.rollfusion.pl, provided that the order has not yet been handed over to the delivery person. The person receiving the cancellation or modification may request the order number or delivery address to confirm the details.
Complaint procedure
The User has the right to submit a complaint to the Service Provider regarding the Services.
Complaints regarding the Services are handled by the Service Provider.
A properly submitted complaint regarding the Services should contain at least the following data:
User's data (name, surname, email address)
subject of the complaint;
circumstances justifying the complaint.
Complaints not containing the above data will not be considered. Complaints should be sent to the email address: rollusion2024@gmail.com with the subject: “Complaint”
The Service Provider will make every effort to consider the complaint within 14 days of its receipt from the User. The Service Provider will immediately inform the User of its decision resulting from the complaint consideration by email to the email address provided in the complaint.
